A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that it is necessary to examine statutes relating to higher education and the University to Hawaii and recodify these laws to determine which statutes may be consolidated, amended, or repealed. Accordingly, the purpose of this Act is to:

(1) Establish the higher education statutory revision interim study group to examine statutes relating to higher education and the University of Hawaii; and

(2) Require the study group to determine an improved organizational framework for these statutes and recommend statutes that may be consolidated, amended, or repealed.

SECTION 2. There is established the higher education statutory revision interim study group to be co-chaired by the chairs of the house committee on higher education and the senate committee on education. The study group shall examine statutes relating to higher education and the University of Hawaii and submit recommendations to the 2005 legislature including:

(1) A proposed improved organizational framework for relevant statutes;

(2) Suggestions for statutes that may be consolidated, amended, or repealed; and

(3) Conforming amendments to other statutes necessary to effectuate the recodification.

The study group shall specifically review chapters 304, 304D, 305, 305A, 305H, 306, 307, 308, and 309, Hawaii Revised Statutes, as well as any other statutes identified by the study group as relevant to the recodification process.

The study group shall be composed of the following members to be jointly appointed by chairs of the house committee on higher education and the senate committee on education:

(1) The chair of the University of Hawaii board of regents or the chair's designee;

(2) The president of the University of Hawaii or the president's designee;

(3) At least one faculty member of the University of Hawaii;

(4) At least one University of Hawaii student; and

(5) Any other individual deemed to have appropriate expertise and experience.

The legislative reference bureau shall provide technical assistance to the study group, including ensuring clarity and conformance with proper statutory construction.

The study group shall submit its findings and recommendations to the legislature no later than twenty days before the convening of the regular session of 2005.

SECTION 3. This Act shall take effect upon its approval.
