A BILL FOR AN ACT

 

relating to highway safety.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§291C-   Burning material thrown from motor vehicles; prohibited. (a) Notwithstanding sections 291C-133 and 339-4, no person shall discard burning material from a motor vehicle that is on a highway or roadway.

(b) Any person who violates this section shall be fined not more than $10,000.

(c) This section shall not apply to situations where the discarding of burning material from the motor vehicle was necessary for emergency health or safety purposes.

(d) As used in this section, "burning material" includes a lighted cigarette, cigar, or match, or any other ignited material."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
