PROPOSING AN AMENDMENT TO ARTICLE I, SECTION 7 OF THE HAWAII STATE CONSTITUTION, TO ALLOW CERTAIN TYPES OF SEARCHES AND SEIZURES INVOLVING ILLICIT DRUGS, WITHOUT A WARRANT AS PROVIDED BY LAW.

Proposes a constitutional amendment to allow certain types of searches and seizures involving illicit drugs, without a warrant as provided by law.

RELATING TO CRIME REDUCTION.

Establishes "walk and talk" procedures and updates wiretapping statutes.

RELATING TO CHILD SUPPORT ENFORCEMENT.

Authorizes the issuance of income withholding orders in situations where the obligor or obligee makes a request to the Child Support Enforcement Agency for income withholding. Allows CSEA to notify employers of the medical insurance coverage provision requirement by regular mail or transmission by electronic means.

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII.

Proposes a constitutional amendment to provide the public with the right of access to registration information regarding persons convicted of crimes against children and persons convicted of sexual offenses. Allows the Legislature to define registration

PROPOSING AMENDMENTS TO ARTICLE I, SECTION 14, OF THE HAWAII CONSTITUTION.

Proposes a constitutional amendment to allow the Legislature to pass legislation to: (1) provide that the prior sexual history of an alleged sexual assault victim is inadmissible in court; and (2) establish the inadmissibility of privileged confidential communications between an alleged crime victim and the alleged victim's physician, psychologist or counselor.

PROPOSING AMENDMENTS TO ARTICLE I, SECTION 5, OF THE HAWAII CONSTITUTION.

Proposes a constitutional amendment to allow the Legislature to pass legislation: (1) permitting witnesses, including criminal defendants, to be impeached with evidence of prior felony convictions and convictions involving dishonesty; and (2) allowing criminal defendants' otherwise excludable statements to be admitted into evidence in criminal trials if the defendant testifies.

RELATING TO OFFENSES AGAINST PUBLIC ADMINISTRATION.

Creates 2 new offenses related to illegal compensation of public servants: (1) bribery in the second degree; and (2) unlawful gifts to public servants by persons subject to their jurisdiction.
