A BILL FOR AN ACT

 

RELATING TO THE TRANSPORTATION OF PUBLIC SCHOOL STUDENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-406, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-406[]] Transportation of public school [children.] students. (a) The department may provide suitable transportation [to]:

(1) To and from school [and for];

(2) For educational field trips; and

(3) For sanctioned, organized, extracurricular school activities

for all [children] students in grades kindergarten to twelve and in special education classes.

(b) The department shall provide suitable transportation as described in subsection (a), for students who reside in rural areas without public transportation.

(c) The department shall adopt [such policy, procedure, and program] policies, procedures, and programs as it deems necessary to provide suitable transportation[.] for students; provided that the policies, procedures, and programs shall provide all students residing in rural areas without public transportation with equal opportunities to participate in sanctioned, organized, extracurricular school activities.

In formulating the [policy, procedure, and program,] policies, procedures, and programs, the department shall consider the [school] following:

(1) The school district[; the school];

(2) The school attendance area in which [a school child] the student normally resides[; the distance];

(3) The distance the [school child] student lives from the school[; the availability];

(4) The availability of public carriers or other means of transportation[; the frequency,];

(5) The frequency, regularity, and availability of public transportation[; and the grade];

(6) The grade level, physical handicap, or special learning disability of a [school child, and it may also consider such] student;

(7) The ability of the student to participate in sanctioned, organized, extracurricular school activities; and

(8) Any conditions and circumstances unique or peculiar to a county or area.

[(b)](d) The department shall adopt rules under chapter 91 governing the supervision and administration of the transportation of [school children] students under this section."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
