A BILL FOR AN ACT

 

relating to motor vehicle registration.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§286- Registration of rental or U-drive motor vehicles. (a) Notwithstanding any other law to the contrary, every certificate of registration issued by the director of finance of a county for rental or U-drive motor vehicles owned by a motor vehicle rental company shall be issued for a period of two years.

(b) In the event that a motor vehicle rental company surrenders the certificate of registration for the rental or U-drive motor vehicle prior to the expiration of the registration, the director shall provide a credit voucher for the unused portion of the registration period.

(c) The director of finance of each county may adopt rules to carry out the purposes of this section and shall expend funds from the director's operating funds as may be necessary for these purposes.

(d) For the purposes of this section:

"Motor vehicle rental agreement" means any written agreement setting forth the terms and conditions governing the use of a motor vehicle that is rented or leased from a motor vehicle rental company.

"Motor vehicle rental company" means any company that is primarily in the business of providing motor vehicles to the public under a motor vehicle rental agreement for a period not to exceed ninety days."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum or $250,000 or so much thereof as may be necessary for fiscal year 2005-2006 for computer programming and any additional equipment or personnel necessary to upgrade the motor vehicle registration system.

The sum appropriated shall be expended by the city and county of Honolulu for computer programming and any additional equipment or personnel necessary to upgrade the motor vehicle registration system.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect July 1, 2005.
