HOUSE CONCURRENT

RESOLUTION

 

requesting the department of education to enter into an agreement with theodora mallick OR the proPERTY OWNER who succeeds her for the construction of the pahoa high and intermediate school gymnasium.

 

 

WHEREAS, the Puna District is one of the fastest growing regions on the island of Hawaii; and

WHEREAS, as it grows, Puna residents are experiencing serious social problems, such as drug abuse, teenage pregnancy, child abuse, domestic violence, and unemployment; and

WHEREAS, one strategy to counteract many of the social problems involving our youth is to provide a range of after-school activities that oftentimes can take place in community facilities such as gymnasiums; and

WHEREAS, Pahoa High and Intermediate School is currently using an old, inadequate, County of Hawaii facility that was built in the 1930s; however, the State has no immediate plans to construct a gymnasium for Pahoa High and Intermediate School; and

WHEREAS, nevertheless, a new school gymnasium would provide an ideal facility where a variety of youth activities could help to serve as a deterrent for many of these social problems; and

WHEREAS, a new school gymnasium would also serve as home to a stronger physical education and sports program for Pahoa High and Intermediate School students; and

WHEREAS, given the State's plan not to proceed with its own new gymnasium, a public-private partnership could result in the construction of a new facility within a shorter period of time and at a lower cost to taxpayers; and

WHEREAS, Mrs. Theodora Mallick is the owner of a 19.8 acre parcel near Pahoa High and Intermediate School, a portion on which she is willing to construct a gymnasium for the school, provided that the State purchases the gymnasium and the land on which it is built, as in the case of Waikoloa Elementary School, which was built by a private landowner after assurances that the State would purchase the school; and

WHEREAS, Mrs. Theodora Mallick is currently negotiating to sell or lease the property and may soon consummate a transaction that would require the new owner or lessee to honor an agreement to construct a gymnasium for the school, using plans approved by the Department of Education and similar to those developed for Waiakea High School; and

WHEREAS, the agreement would include construction of an extension of Kauhale Road to the section of Homestead Road fronting her property, that may enable the County of Hawaii to close the dangerous portion of Homestead Road that divides Pahoa Elementary School from the cafeteria at Pahoa High and Intermediate School, which they share; and

WHEREAS, to help make this public-private partnership arrangement a reality, the Legislature appropriated $450,000 in 2002 and $3,750,000 in 2004; additional funds are being requested in the 2005-2007 biennium budget to allow the partnership to proceed; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that the Department of Education (DOE) is requested to enter into an agreement with Mrs. Theodora Mallick, or the property owner who succeeds her, for the construction of a gymnasium for Pahoa High and Intermediate School and for the purchase of the land and building; and

BE IT FURTHER RESOLVED that DOE is requested to provide to the Legislature the details of the scope, timetable, and cost of the real estate transaction when an agreement has been reached; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Education, Superintendent of Education, State Comptroller, and the property owner proposing to build a gymnasium for Pahoa High and Intermediate School.
