A BILL FOR AN ACT

 

RELATING TO MONKEYS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§142-   Monkeys; prohibited in commercial establishments. (a) Except for any county or state programs, projects, or facilities that involve monkeys, including county operated zoos, and certified animal sanctuary habitats, the public display of any live species of monkey is prohibited in commercial establishments or businesses, including establishments or businesses under the jurisdiction of a county liquor commission under section 281-17.

(b) The prohibitions of subsection (a) shall not apply to one-time commercial use for television or motion picture filming, or performances in a circus involving primates.

For the purposes of this section:

"Monkey" shall include other non-human species of primates;

"Commercial establishment or business" means any establishment or business that is required to hold a general excise tax license under section 237-9; and

"One-time commercial use" means the entire duration of filming or the total number of circus performances.

(c) Violation of this section shall be a misdemeanor. Penalties imposed under this section shall be in addition to, and not in lieu of, any other penalty provided by law."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
