A BILL FOR AN ACT

 

relating to historic preservation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§6E-   World War II bunker inventory; historic register; offense. (a) The state historic preservation officer shall conduct a survey to establish a statewide inventory that identifies and documents all remaining World War II concrete bunker structures in the State.

The department of land and natural resources shall seek assistance from appropriate public, private, and nonprofit agencies and veterans groups and may employ consultants as necessary to implement this section.

(b) Within thirty days of its completion, the inventory and other relevant information or documents relating to the World War II concrete bunker structures in the State shall be provided to the Hawaii historic places review board, which shall order and enter the identified World War II bunkers into the Hawaii register of places, as appropriate, under section 6E-5.5.

(c) Defacing or damaging a World War II bunker shall constitute criminal property damage under part III of chapter 708. For purposes of determining the level of the offense of criminal property damage to be charged, the cost of cleaning and restoring the property shall be deemed the monetary amount of damage to the structure."

SECTION 2. The state historic preservation officer shall submit a report of the activities conducted to carry out the purposes of this Act to the legislature by June 30, 2006.

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2020.
