A BILL FOR AN ACT

 

relating to educational facilities.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Although the Reinventing Education Act of 2004 implemented much needed changes to improve the State's education system, still more improvements are necessary, particularly in the area of school repair and maintenance. The improvements that have been made and will be made to the educational system will all be in vain if the State cannot provide sufficient facilities.

The legislature finds that there has been some progress in completing necessary repair and maintenance projects; however, numerous projects remain unfulfilled. In order to accomplish the State's obligation to provide a quality and healthy educational environment, the State needs to make a commitment to maintaining its public school facilities.

The purpose of this Act is to authorize the issuance of general obligation bonds and appropriate funds for the repair and maintenance of state educational facilities.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $200,000,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006, for deposit into the state educational facilities repair and maintenance account established under section 36-35, Hawaii Revised Statutes.

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $200,000,000, or so much thereof as may be necessary for fiscal year 2005-2006, for the repair and maintenance of state educational facilities.

SECTION 5. The sums appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 6. This Act shall take effect on July 1, 2005.
