A BILL FOR AN ACT

 

relating to substance abuse.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the purchase and delivery of substance abuse treatment services should result in positive outcomes. Providers should be reimbursed according to the degree of success achieved by the provision of their services. Substance abuse treatment services outcomes should be measured, monitored, and evaluated to determine the success of treatment outcomes. The purpose of this Act is to institute a reimbursement system by which substance abuse treatment providers are reimbursed for the provision of substance abuse treatment services according to the degree of success achieved by those services as measured, monitored, and evaluated in treatment outcomes.

SECTION 2. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§321-    Substance abuse treatment services; positive outcomes reimbursement system; monitoring; criteria to measure success; rules. (a) The director of health shall develop a positive outcomes reimbursement system. The director shall implement for all contracts for substance abuse treatment services a range of reimbursement rates on a sliding scale that is directly tied to the degree of success achieved in treating individuals with substance abuse; provided that no payment shall be made for any treatment service the outcome of which the director has determined is unsatisfactory.

(b) The positive outcomes reimbursement system shall utilize the statewide substance abuse treatment monitoring program established under section 321-192.5 to monitor, evaluate, and determine the effectiveness of substance abuse treatment services provided by the department under this part for the purpose of implementing the positive outcomes reimbursement system. The director shall review the provision of substance abuse treatment services according to criteria under section 321-192.5(b) established to measure the success of treatment for individuals with substance abuse.

(c) The director shall adopt rules in accordance with chapter 91 to establish an appropriate sliding scale reimbursement range and to fully implement this section."

SECTION 3. Chapter 352D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§352D-    Substance abuse treatment services; positive outcomes reimbursement system; monitoring; criteria to measure success; rules. (a) The executive director of the office of youth services shall develop a positive outcomes reimbursement system. The executive director shall implement for all contracts for substance abuse treatment services a range of reimbursement rates on a sliding scale that is directly tied to the degree of success achieved in treating individuals with substance abuse; provided that no payment shall be made for any treatment service the outcome of which the executive director has determined is unsatisfactory.

(b) The positive outcomes reimbursement system shall utilize the statewide substance abuse treatment monitoring program established under sections 321-192.5 and 352D-4.5 to monitor, evaluate, and determine the effectiveness of substance abuse treatment services provided by the office of youth services under this chapter for the purpose of implementing the positive outcomes reimbursement system. The executive director shall review the provision of substance abuse treatment services according to criteria under section 321-192.5(b) established to measure the success of treatment for individuals with substance abuse.

(c) The executive director shall adopt rules in accordance with chapter 91 to establish an appropriate sliding scale reimbursement range and to fully implement this section."

SECTION 4. Chapter 601, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§601-_    Substance abuse treatment services; positive outcomes reimbursement system; monitoring; criteria to measure success; rules. (a) The administrative director of the courts shall develop a positive outcomes reimbursement system. The administrative director shall implement for all contracts for substance abuse treatment services a range of reimbursement rates on a sliding scale that is directly tied to the degree of success achieved in treating individuals with substance abuse; provided that no payment shall be made for any treatment service the outcome of which the administrative director has determined is unsatisfactory.

(b) The positive outcomes reimbursement system shall utilize the statewide substance abuse treatment monitoring program established under sections 321-192.5 and 601-21 to monitor, evaluate, and determine the effectiveness of substance abuse treatment services provided by the judiciary for the purpose of implementing the positive outcomes reimbursement system. The administrative director shall review the provision of substance abuse treatment services according to criteria under section 321-192.5(b) established to measure the success of treatment for individuals with substance abuse.

(c) The administrative director shall adopt rules in accordance with chapter 91 to establish an appropriate sliding scale reimbursement range and to fully implement this section."

SECTION 5. Chapter 353G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§353G-_    Substance abuse treatment services; positive outcomes reimbursement system; monitoring; criteria to measure success; rules. (a) The director of public safety shall develop a positive outcomes reimbursement system. The director of public safety shall implement for all contracts for substance abuse treatment services a range of reimbursement rates on a sliding scale that is directly tied to the degree of success achieved in treating individuals with substance abuse; provided that no payment shall be made for any treatment service the outcome of which the director of public safety has determined is unsatisfactory.

(b) The positive outcomes reimbursement system shall utilize the statewide substance abuse treatment monitoring program established under sections 321-192.5 and 353G-13 to monitor, evaluate, and determine the effectiveness of substance abuse treatment services provided by the department of public safety for the purpose of implementing the positive outcomes reimbursement system. The director of public safety shall review the provision of substance abuse treatment services according to criteria under section 321-192.5(b) established to measure the success of treatment for individuals with substance abuse.

(c) The director of public safety shall adopt rules in accordance with chapter 91 to establish an appropriate sliding scale reimbursement range and to fully implement this section."

SECTION 6. New statutory material is underscored.

SECTION 7. This Act shall take effect upon its approval.
