A BILL FOR AN ACT

 

 

relating to the overpayment of teachers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart B of part III to be appropriately designated and to read as follows:

"§302A-    Overpayment of teachers; recovery.  Notwithstanding section 657-1.5, an action by the State or department for the recovery of moneys based upon an overpayment to a teacher, where the overpayment is due to the department's error, shall be barred unless commenced within two years of the date of the overpayment."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
