A BILL FOR AN ACT

 

relating to capital improvement projects for the benefit of the sixth senatorial district.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The sixth senatorial district, encompassing the islands of Moloka'i, Lana'i, and Kaho'olawe, Hana, and east and upcountry Maui, is one of the last "canoe" districts. Thus, each island area has vastly different CIP needs. The purpose of this Act is to appropriate funds for capital improvement projects in the sixth senatorial district.

Part I.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $59,833,000, or so much thereof as may be necessary, for fiscal year 2005-2006, for the purpose of the following transportation projects in the sixth senatorial district:

1. Haleakala Highway Widening

a. Construction for the widening of Haleakala Highway from three to four lanes between Pukalani bypass to Hana Highway.

2. Paia Bypass

a. Plans for alternative traffic improvements in the vicinity of Paia town.

A. For areas adjacent to

A. Plans, design, and construction for a bridge next to Meyer's place.

SECTION 3. The appropriation made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 4. The sums appropriated shall be expended by the department of transportation for the purposes of this Act.

Part II.

SECTION 5. The director of finance is authorized to issue general obligation bonds in the sum of $30,018,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of capital improvements to educational facilities.

7. Ha'iku School

8. Ha'iku Elementary School, Maui

A. Design and construction for sidewalks, school playground, and park fencing for Ha'iku elementary school and school zone signs from Ha'iku elementary school to Kahiapo road.

a. Design and construct a new cafeteria building; ground and site improvements; equipment and appurtenances. The existing structure is over 60 years old, made of wood, undersized, and lacks a stage.

SECTION 6. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 7. The sum appropriated shall be expended by the department of education for the purposes of this Act.

Part III.

SECTION 8. The director of finance is authorized to issue general obligation bonds in the sum of $1,950,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of capital improvements to agricultural projects in the sixth senatorial district.

23. Agricultural Park, Lana'i

A. Plans, design, and construction to develop the infrastructure for an agricultural park.

24. Moloka'i irrigation system

A. Plans, design, and construction of capital improvements to the Moloka'i irrigation system.

SECTION 9. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 10. The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

Part IV.

SECTION 11. The director of finance is authorized to issue general obligation bonds in the sum of $17,500,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of projects on the island of Kahoolawe.

A. Improvement projects for Kahoolawe.

25. Kahoolawe Island Reserve Commission

Kuhela Operations Center.

SECTION 12. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 13. The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

Part V.

SECTION 14. The director of finance is authorized to issue general obligation bonds in the sum of $5,500,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of capital improvements to library facilities in the sixth senatorial district.

29. Plans, design, and construction of expansion to Makawao library.

SECTION 15. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 16. The sum appropriated shall be expended by the department of education for the purposes of this Act.

Part VI.

SECTION 17. The director of finance is authorized to issue general obligation bonds in the sum of $5,600,000 or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of providing affordable housing opportunities in the sixth senatorial district.

30. Hana affordable housing project, Maui.

A. Plans, design, and construction of affordable housing on lands donated by Hana Ranch.

SECTION 18. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 19. The sum appropriated shall be expended by the department of human services for the purposes of this Act.

Part VII.

SECTION 20. The director of finance is authorized to issue general obligation bonds in the sum of $1,941,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of providing services to residents in the sixth senatorial district.

31. Lana'i Veteran's cemetery, Lana'i

A. Plans, design, construction, and equipment for a water storage and irrigation system; provided that the county of Maui provides a one-to-one match of in-kind services.

SECTION 22. The sum appropriated shall be expended by the county of Maui for the purposes of this Act.

Part VIII.

SECTION 23. This Act shall take effect on July 1, 2005.
