A BILL FOR AN ACT

 

RELATING TO THE UNIVERSITY OF HAWAII.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§78-   Penalty for late payments of wages to university personnel. The board of regents of the University of Hawaii shall pay a civil penalty of $100 to each employee covered under section 304-11 for whom the board of regents has failed to pay the employee's wages within one pay period following the designated pay day under the after-the-fact payroll. The penalty shall only be available once to the employee while the employee occupies the employment position for which the penalty is being applied and shall not be compounded; provided that if an employee transfers to another employment position within the University of Hawaii system and the board of regents fails to pay the employee's wages within one pay period following the designated pay day under the after-the-fact payroll, then the employee shall be entitled to the proceeds of the civil penalty authorized under this section."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2050.
