Provides for the manner in which the prevailing wages for laborers and mechanics on public work projects is to be established. Allows all individuals to bring suit for injunctive relief for violations of chapter 104.

RELATING TO PROCUREMENT.

Amends public procurement code to prohibit a governmental body from requiring a contractor for construction design professional services to indemnify the governmental body for the acts or omissions of the governmental body, or of parties for whom the contractor is not legally liable. Allows the governmental body to require the contractor to indemnify the governmental body for the contractor's negligent or intentional acts and omissions.

RELATING TO THE OFFICE OF PLANNING.

Clarifies that the Department of Business, Economic Development, and Tourism has sole jurisdiction over land use and state planning functions and that the Office of Planning shall report to DBEDT and no other executive department. Requires that the Director of the Office of Planning be appointed with the advice and consent of the Senate.

RELATING TO HIGH TECHNOLOGY.

Establishes the High Technology Innovation Corporation, a nonprofit corporation attached to the High Technology Development Corporation, to assist in attracting high technology development opportunities to the State.

RELATING TO TOURISM.

Increases transient accommodations tax (TAT) allocations to the Tourism Special Fund and Convention Center Enterprise Special Fund; adds the Executive Director of the SFCA to the Board of HTA as an ex-officio nonvoting member; repeals TAT Trust Fund; allocates TAT revenue for Aloha Aina patrols and visitor assistance programs in each county; clarifies and amends HTA administration.

RELATING TO THE EMPLOYMENT SECURITY LAW.

Improves the administration of unemployment taxes and eliminates the practice of "dumping" whereby some employers and financial advisors use acquisitions or restructuring schemes, including shifting of workforce and payroll, to pay lower state unemployment taxes.
