A BILL FOR AN ACT

 

making an appropriation to implement act 112, session laws of hawaii, 2005.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the purpose of Act 112, Session Laws of Hawaii, 2005, was to enhance law enforcement tools by establishing a statewide deoxyribonucleic acid (DNA) database and date bank identification program for all convicted felons. Expanding the DNA database helps to prevent crimes, solve crimes through "cold hits", and assists in exonerating wrongfully convicted people.

The legislature further finds that the legislature removed funding authorization language from the final version of Act 112, Session Laws of Hawaii, 2005, hampering efforts to meet the requirements of the Act. The purpose of this Act is to provide the funding necessary to fully implement Act 112, Session Laws of Hawaii, 2005.

SECTION 2. There is appropriated out of the DNA registry special fund the sum of $          , or so much thereof as may be necessary, for fiscal year 2006-2007 to carry out the purposes of this Act.

The sum appropriated shall be expended by the department of the attorney general to carry out the purposes of this Act including, but not limited to, reimbursement to the county police departments and the department of public safety for costs incurred in carrying out the purposes of this Act.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, to be deposited into the DNA registry special fund.

The sum appropriated shall be expended by the department of the attorney general to carry out the purposes of this Act including, but not limited to, reimbursement to the county police departments and the department of public safety for costs incurred in carrying out the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2006.
