A BILL FOR AN ACT

 

RELATING TO PRE-PAID PHONE CARDS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to allow inmates under the jurisdiction of the department of public safety to use pre-paid phone cards to make phone calls.

SECTION 2. Chapter 353, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§353- Access to pre-paid phone cards. The director shall allow access to pre-paid phone cards for use by inmates under the jurisdiction of the department to make local and long-distance phone calls. The pre-paid phone cards shall be made available to pre-trial detainees and convicted offenders housed at Hawaii correctional facilities and out-of-state contracted facilities. The inmate's family members may provide the pre-paid phone cards. "Family members" means persons who are related to each other by blood, marriage, adoption, or legal guardianship.

The department shall develop policies and procedures to minimize any security risk associated with the phone cards.

Nothing in this section shall be construed to mean the department is required to provide pre-paid phone cards to inmates."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
