HOUSE OF REPRESENTATIVES

H.B. NO.

2069

TWENTY-THIRD LEGISLATURE, 2006

H.D. 1

STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO FAMILY SERVICE CENTERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that community access to information and services strengthens and stabilizes Hawaii's families. Community-based, family-centered delivery models exemplify cooperation between public and private entities to deliver coordinated services to a target population. Such models provide families with a community-based, one-stop resource center for information and referrals, volunteer programs, counseling, classes, and family activities. These models are particularly effective because they are places where people feel comfortable asking for assistance. The models support the needs of individuals and families, and provide programs that encourage family strengthening, skill enhancement, and community involvement.

The purpose of this Act is to support contracts awarded for the development of community-based, family-centered delivery models throughout the state through the establishment of the community-based, family-centered delivery models special fund.

SECTION 2. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§346-   Community-based, family-centered delivery models special fund. (a) There is established within the state treasury a community-based, family-centered delivery models special fund, into which shall be deposited the following moneys:

(1) Appropriations made by the legislature to the fund;

(2) Gifts, donations, and grants from public agencies and private persons; and

(3) Any other revenues designated for the fund.

The fund shall be administered by the department. All interest earned or accrued on moneys deposited in the fund shall become part of the fund. The moneys deposited into the fund shall be retained or disbursed by the department pursuant to this section.

(b) Moneys from the fund shall be used by the department to award contracts for purchases of services, pursuant to chapter 103F, to:

(1) Establish and maintain community-based, family-centered delivery models throughout the state;

(2) Elicit community input to identify locations for community-based, family-centered delivery models and the kinds of services to be provided;

(3) Develop and implement a quality assurance mechanism to evaluate the efficacy of programs and services, monitor family involvement, and ensure ongoing participation with programs and services; and

(4) Pay operating expenses for purposes of this section.

Moneys shall be used for new and existing programs and shall not supplant any other funds previously allocated to these programs. The fund shall be kept separate from all other funds in the treasury.

(c) For every dollar of state funds contracted by the fund to a project, there shall be a minimum of $1 in value matching from private, federal, county, or community sources.

(d) The department shall expend moneys to award contracts in accordance with chapter 103F; provided that awardees shall be required to demonstrate collaboration with community organizations in support of community-based family-centered delivery models.

(e) The department shall submit an annual report to the legislature prior to the convening of each regular session providing an accounting of the receipts of and expenditures from the fund.

(f) For purposes of this section:

"Community-based, family-centered delivery model" means a venue that is in the community to serve as a resource hub and provide family-strengthening services for families that are at-risk for child abuse or neglect, substance abuse, poverty, untreated mental illness, developmental disabilities, homelessness, and any other factor that may negatively impact a family.

"Fund" means the community-based, family-centered delivery models special fund."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2006-2007 to be deposited into the community-based, family-centered delivery models special fund for purposes of this Act.

The sum appropriated shall be expended by the department of human services for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2006.
