A BILL FOR AN ACT

 

relating to elections.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§11- Public officials; public service announcements; public funds. (a) No public service announcement or advertisement that:

(1) Is produced on behalf of any state-administered program or paid for with state or public funds; and

(2) Contains the proper name, image, or voice of any elected official or candidate for office,

shall be broadcast or aired on radio, television, or printed in a commercial newspaper or commercial magazine three months prior to any public election in the state.

(b) An elected official or candidate who appears in an advertisement or public service announcement broadcast or printed in response to a disaster or national emergency shall be exempt from subsection (a) if the announcement is reasonably necessary to the official function of the official or candidate.

(c) This section shall not be construed to prohibit an official or candidate from appearing in the broadcast of official state or county proceedings by a regular state or county television broadcast service."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
