A BILL FOR AN ACT


 

 

relating to affordable housing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Notwithstanding any provisions to the contrary in part VII of chapter 206E, Hawaii Revised Statutes, the Hawaii community development authority, in cooperation with the city and county of Honolulu, shall develop a plan for an affordable housing community within the Kalaeloa community development district established under section 206E-193, Hawaii Revised Statutes.  The development plan shall include:

     (1)  A public-private partnership for a master-planned community with a mixed-use design incorporating compatible industrial, commercial, residential, and public uses that may coexist within the same area;

     (2)  A connection to the Oahu mass transit project provided for under Act 247, Session Laws of Hawaii 2005, that is convenient for riders;

     (3)  Ample parks and open space maintaining a rural character and lifestyle; and

     (4)  Mixed-income residential dwellings, including rental units and for-sale owner-occupied units, wherein at least fifty per cent of the units in a single project shall be set aside as affordable rental and for-sale owner-occupied units as follows:

         (A)  At least thirty-three per cent for households with incomes at or below sixty per cent of the area median income as determined by the United States Department of Housing and Urban Development;

         (B)  At least thirty-four per cent for households with incomes up to one hundred per cent of the area median income as determined by the United States Department of Housing and Urban Development; and

         (C)  At least thirty-three per cent for households with incomes up to one hundred forty per cent of the area median income as determined by the United States Department of Housing and Urban Development.

     The development plan shall preserve all of the units as affordable in perpetuity by considering community land trusts and other strategies.  The authority shall consult with the surrounding community and consider public input throughout the planning process.  Nothing herein shall supersede, conflict with, or duplicate any of the work already conducted by the authority in its approved reuse plan and any subsequent amendments thereto as authorized under section 206E-194(2), Hawaii Revised Statutes.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2007-2008 for the Hawaii community development authority, in cooperation with the city and county of Honolulu, to develop a plan for an affordable housing community within the Kalaeloa community development district.

     The sum appropriated shall be expended by the Hawaii community development authority for the purposes of this Act.

     SECTION 3.  No later than twenty days prior to the convening of the regular session of 2008, the Hawaii community development authority shall submit to the legislature a report of the authority's progress in developing a plan for an affordable housing community within the Kalaeloa community development district.

     SECTION 4.  No later than twenty days prior to the convening of the regular session of 2009, the Hawaii community development authority shall submit to the legislature a final report of the authority's development plan for an affordable housing community within the Kalaeloa community development district, including any proposed legislation.

     SECTION 5.  This Act shall take effect on July 1, 2007.
