A BILL FOR AN ACT


 

 

relating to water rates for agricultural uses.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§269-      Ratemaking; furnishing of water for agricultural use.  The public utilities commission shall require private entities that furnish water used for agricultural purposes in an area zoned for agricultural use to establish a water rate structure for agricultural water use that is comparable to the water rate structure used by the local county board of water supply.  The difference in water rates between agricultural uses and other uses of water established by the local county board of water supply shall be used as a guide for the water rate structure established by the private entity furnishing the water.  The private entity furnishing the water shall use the same requirements established by the local county board of water supply to determine eligibility for the agricultural water use rates.  All private entities furnishing water used for agricultural purposes in an area zoned for agricultural use shall establish a water rate structure for agricultural water use by January 1, 2008."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
