A BILL FOR AN ACT


 

 

relating to cruise ship fees.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§200-    Cruise ships; annual cost report; statutory fees.  (a)  Beginning on December 31, 2007, for all cruise ships that use any small boat harbor in the State under the jurisdiction of the department, including the use of anchorage tendering and shuttling cruise ship passengers to shore and back to the cruise ships on small tendering vessels, the department shall report to the legislature, by December 31 of each year, the total cost or expense incurred by the department to address the usage activities of the cruise ships including but not limited to the cost of:

     (1)  Managers;

     (2)  Enforcement officers;

     (3)  Harbor agents;

     (4)  Clerks;

     (5)  Maintenance and janitorial workers;

     (6)  Dockside security services;

     (7)  Parking;

     (8)  Additional janitorial services;

     (9)  Water patrols;

    (10)  Repairs; and

    (11)  Any other relevant costs.

     (b)  All fees assessed upon cruise ships shall be set by statute; provided that fee rules existing on the effective date of this Act shall remain in effect until superseded by statute.  Beginning with the regular session of 2008, the department shall submit proposed legislation to the legislature for consideration during the regular session of 2008, and for each regular session thereafter, recommending the amount of fees to be assessed upon cruise ships for the upcoming year necessary to completely offset the cost or expense, but not more, of addressing the usage activities of the cruise ships in small boat harbors in the State under the jurisdiction of the department.  The department shall recommend in the annual proposed legislation:

     (1)  The form and amount of fees for the upcoming year, which shall be based upon cost data collected two years prior; and

     (2)  That the proposed fees take effect on July 1 of the appropriate year."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
