A BILL FOR AN ACT


 

 

relating to greenhouse gas emissions.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature adopts the report prepared by the department of business, economic development, and tourism, energy, resources, and technology division and the department of health, clean air branch in July 1997, entitled "Inventory of Hawaii Greenhouse Gas Emissions Estimates for 1990," which includes a statewide inventory of the greenhouse gas emissions produced by anthropogenic activity in Hawaii in 1990, as the estimated greenhouse gas emissions in 1990, to be used as the basis for future statewide greenhouse gas emissions reduction goals.

     SECTION 2.  The department of health with the assistance of the department of business, economic development, and tourism shall prepare and submit to the legislature at least twenty days prior to the convening of the regular session of 2009, the Hawaii comprehensive clean air plan (plan).  The plan shall present statewide measures to reduce the statewide greenhouse gas emissions level to seven per cent below the estimated greenhouse gas emissions for 1990, as suggested for the United States in the Kyoto Protocol, including proposed legislation necessary to implement the plan. 

     The departments shall consider the suitability of implementing measures adopted in other states to meet reduction goals, in Hawaii, taking into consideration the geographic, economic, cultural, and other unique characteristics of our state.

     The ultimate goal of the plan shall be to reduce the statewide greenhouse gas emissions to the lowest per capita amount in the nation. 

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $      or so much thereof as may be necessary for fiscal year 2007-2008 for the department of health to prepare the Hawaii comprehensive clean air plan.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2007.
