A BILL FOR AN ACT


 

 

relating to public access to criminal history.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 846E-1, Hawaii Revised Statutes, is amended as follows:

     1.   By adding two new definitions to be appropriately inserted and to read:

     ""Drug offender" means a person who has been convicted at any time of a "drug offense".

     "Drug offense" means an offense that is:

     (1)  Set forth in section 712-1240.5, 712-1240.7, 712-1240.8, or 712‑1241;

     (2)  Any federal, military, or out-of-state conviction for any offense that under the laws of this State would be a drug offense as defined in paragraph (1); or

     (3)  An act, as described in chapter 705, that is an attempt, criminal solicitation, or criminal conspiracy to commit one of the offenses designated in paragraphs (1) and (2)."

     2.   By amending the definitions of "covered offender" and "covered offense" to read as follows:

     ""Covered offender" means a "sex offender" [or], an "offender against minors", or a "drug offender", as defined in this section.

     "Covered offense" means a criminal offense that is:

     (1)  A crime within the definition of "crimes against minors" in this section; [or]

     (2)  A crime within the definition of "sexual offense" in this section[.]; or

     (3)  A crime within the definition of "drug offense" in this section."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
