HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING A STUDY OF THE REGULATION AND CONTROL OF THE BEACH CONCESSIONS AT WAIKIKI BEACH.

 

 

 


     WHEREAS, traditionally the unique Native Hawaiian culture and the aloha spirit have been nobly represented by Waikiki's "beach boy" concession stands, which offer visitors the opportunity to learn surfing and canoe paddling Hawaiian-style and to experience the excitement of riding the ocean waves; and

 

     WHEREAS, the beach boy concessions at Waikiki have contributed to the preservation of Hawaii's cultural heritage and provided native Hawaiians and other kamaaina an opportunity to profit economically and socially from the interaction of their native culture and other cultures from around the world; and

 

     WHEREAS, the once-peaceful terrain on which the beach boys plied their trade has increasingly been shaken by reports or accusations of cutthroat competition, violence, favoritism, ineffective government regulation, violation of applicable rules, and disregard of the rights and culture of native Hawaiians; and

 

     WHEREAS, a study would be helpful in assisting the State, City and County of Honolulu, native Hawaiian community, and private tourism industry toward the peaceful, fair, and just resolution of the tensions that surround the Waikiki beach concessions; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Legislative Reference Bureau is requested to conduct a study of the regulation and control of the beach concessions at Waikiki, with particular attention to those types of concessions that offer surfing and canoe paddling; and

 

     BE IT FURTHER RESOLVED that the study is required to include but not be limited to the following:

 

     (1)  Identification of the roles and responsibilities of the governmental, quasi-governmental, and private entities that regulate, control, and shape the system of Waikiki beach concessions;

 

     (2)  Identification of the most pressing issues, problems, and conflicts surrounding the Waikiki beach concessions; and

 

     (3)  Identification and analysis of possible solutions to the problems through legislation or other approaches; and

 

     BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to submit, not later than twenty days prior to the convening of the Regular Session of 2008, its findings and recommendations, including any proposed legislation, for helping to resolve the problems that surround the Waikiki beach concessions; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the Director of the Legislative Reference Bureau, Chairperson of the Board of Trustees of the Office of Hawaiian Affairs, Chairperson of the Board of Land and Natural Resources, the Mayor of the City and County of Honolulu, and Chair of the Honolulu City Council.
