A BILL FOR AN ACT


 

 

relating to smoking.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§328J‑A  Disposal of smoking waste.  (a)  No person shall dispose of any cigarette, cigar, or tobacco product, or any part thereof, in any place where smoking is prohibited under this chapter, except in a designated waste disposal container.

     (b)  Any person who violates this section shall be fined not more than $250.

     §328J‑B  Prohibition; public beaches and public parks.  Smoking shall be prohibited:

     (1)  On public beaches;

     (2)  In public parks;

     (3)  In any place within twenty-five feet of areas where playground equipment is installed for public use by children; and

     (4)  In areas posted to require permits to be reserved for recreational use including picnics."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
