A BILL FOR AN ACT


 

 

relating to liability for coqui frog eradication efforts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§141-     Limited immunity; coqui frog eradication; volunteers.  (a)  No governmental agency or private entity shall be liable for any injury or damage sustained by an unpaid volunteer in connection with a coqui frog eradication program or project, except for injury or damage resulting from the gross negligence or wanton acts or omissions of the government agency or private entity.

     (b)  For purposes of this section:

     "Agency" means a department, agency, board, commission, council, task force, committee, or other political subdivision of a county or the State that administers, manages, or otherwise engages in coqui frog eradication programs or projects.

     "Entity" means an individual, company, corporation, partnership, community group, or other legal entity that administers, manages, or otherwise engages in invasive species control and eradication programs or projects, including coqui frog eradication."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2112.
