A BILL FOR AN ACT


 

 

relating to mopeds.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291C-197, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Wherever bicycle lanes are provided on [the] a roadway[,] with a speed limit of greater than thirty-five miles per hour, moped drivers shall use such bicycle lanes.  Moped drivers may use bicycle lanes on a roadway with a speed limit of thirty-five miles per hour or less."

     SECTION 2.  Section 291C-198, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  No person shall drive a moped at a speed greater than either thirty-five miles per hour (fifty-eight kilometers per hour)[.] or the posted speed limit for the roadway if less than thirty-five miles per hour.  This prohibition shall apply whether a person drives a moped on a roadway laned for motor vehicles or on a bicycle lane."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect on July 1, 2008.
