A BILL FOR AN ACT


 

 

relating to highways.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that there are numerous highways, roads, lanes, and alleys throughout the State, known as lanes-in-limbo, and particularly prevalent in urban Honolulu, that are privately owned.  However, in many instances the ownership of these lanes-in-limbo can not be readily determined by a search of public records.  This ownership information should be easily and publicly available in the interest of the public's safety and health.  Without this information many residents have no recourse when maintenance of lanes-in-limbo is needed or when hazardous conditions in the lanes-in-limbo affect their adjacent properties.

     The purpose of this Act is to direct the city and county of Honolulu to submit a report to the legislature setting forth in detail the steps that would have to be undertaken and the cost of the undertaking to determine and make available to the public the ownership of all lanes-in-limbo, utilizing the urban core of Honolulu as an initial template in the resolution of a statewide problem.

     SECTION 2.  The city and county of Honolulu is directed to undertake a review and submit a report to the legislature twenty days prior to the convening of the regular session of 2008 setting forth the following:

     (1)  The steps, in detail, that would need to be undertaken to:

         (A)  Determine the ownership of all lanes-in-limbo within the area bounded by Bishop street and Pali highway on the east, School street on the north, Middle street on the west, and the ocean; and

         (B)  Make the information readily available to the public, including posting on the Internet;

     (2)  The time that the task would require; and

     (3)  The cost of the undertaking.

     SECTION 3.  This Act shall take effect upon its approval.
