A BILL FOR AN ACT


 

 

RELATING TO INCOME TAX.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 235, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§235-    Employee public transportation; tax deduction.  (a)  There shall be allowed to employers subject to this chapter, a deduction from gross income equal to the cost of public transportation incurred by the employer's employees that is reimbursed by the employer for public transportation to and from work; provided that the deduction shall not exceed $    per year per employer.

     (b)  For the purposes of this section, "public transportation" means any form of transportation that is provided by the federal, state, or county governments.

     (c)  The director of taxation:

     (1)  Shall prepare such forms as may be necessary to claim a tax deduction under this section;

     (2)  May require proof of the claim for the tax deduction, including an affidavit signed by the employer; and

     (3)  May adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
