Madam:

 

     Your Committee on Agriculture and Hawaiian Affairs, to which was referred H.B. No. 3120, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO ANIMAL QUARANTINE FACILITIES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to authorize the Board of Agriculture to contract with third parties for the use of animal quarantine property or facilities, provided that:

 

     (1)  The Board determines that the property or facilities are not required for use by the animal quarantine program;

 

     (2)  The property or facilities are leased or rented at not less than fifty per cent of fair market value;

 

     (3)  The property or facilities are used for animal welfare; and

 

     (4)  The property or facilities are only used by the third party.

 

     The Hawaiian Humane Society submitted testimony in support of the intent of this measure.  The Department of Agriculture submitted testimony in support of this measure and proposed amendments.  Testimony in opposition to this measure was submitted by Animal CARE Foundation and one individual.

 

     Your Committee has amended this measure by replacing its contents with the contents of S.B. No. 3042 which provides that the Board of Agriculture is authorized to contract, without any restrictions on what the Board may charge for leasing or renting the property or facilities, with third parties for the use or rental of animal quarantine property or facilities; provided that:

 

     (1)  The Board determines that the property or facilities are not required for use by the animal quarantine program; and

 

     (2)  The property or facilities are only used by the third party.

 

     As affirmed by the record of votes of the members of your Committee on Agriculture and Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 3120, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 3120, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
