A BILL FOR AN ACT


 

 

relating to home occupations.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Home occupation.  (a)  Notwithstanding any law to the contrary, no county ordinance regulating home occupations shall prohibit the owner of a home occupation from:

     (1)  Employing less than three employees;

     (2)  Receiving no more than one courier visit per day; and

     (3)  Servicing less than six customers per day.

     (b)  A county may regulate activities of owners of home occupations that are disruptive to the surrounding neighborhood, or are a source of unreasonable noise or noxious fumes.

     For the purposes of this section, "home occupation" means a business operated from a home by the owner occupant of a residential dwelling."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
