A BILL FOR AN ACT


 

 

RELATING TO MILITARY RESERVE COMPONENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 121, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§121-     Sergeant Deyson Cariaga service members' life insurance reimbursement special fund.  (a)  There is hereby established in the state treasury the Sergeant Deyson Cariaga service members' life insurance reimbursement special fund to be administered by the department of defense.  The special fund shall consist of legislative appropriations and income from investment of the fund.  Expenditures from the fund shall be made for reimbursing eligible members of the Hawaii national guard and federal military reserves for premiums paid for benefits under the service members' group life insurance program pursuant to 38 U.S.C. Section 1965 et seq., as amended.

     (b)  Eligibility for reimbursement shall be limited to time periods in which the member of the Hawaii army or air national guard or federal military reserves residing in Hawaii was deployed on active duty to a war zone.

     (c)  The department of defense shall adopt rules under chapter 91 necessary to implement this section."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          , for fiscal year 2009-2010, and the same sum, for fiscal year 2010-2011, for deposit into the Sergeant Deyson Cariaga service members' life insurance reimbursement special fund.

     SECTION 3.  There is appropriated out of the Sergeant Deyson Cariaga service members' life insurance reimbursement special fund of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2009-2010, and the same sum, or so much thereof as may be necessary for fiscal year 2010-2011, for reimbursing eligible members of the Hawaii national guard and federal military reserves for premiums paid for benefits under the service members' group life insurance program.

     The sums appropriated shall be expended by the department of defense for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2009.
