HOUSE RESOLUTION

 

 

requesting the department of health and the department of commerce and consumer affairs to examine THE FEASIBILITY OF restrictiNG the sale of tattooing equipment to minors.

 

 

 


     WHEREAS, currently tattoo artists must be licensed by the Department of Health; and

 

     WHEREAS, the rules of the Department of Health further prohibit tattoo artists from tattooing any person under the age of eighteen years without the written consent of the parents or legal guardian of the minor; and

 

     WHEREAS, the licensure of tattoo artists was established to ensure a healthy and safe environment with respect to the application of tattoos to control or eliminate the risks of adverse health effects, such as the transmission of a disease through an open wound; and

 

     WHEREAS, neither the current law nor related administrative rules address health and safety concerns that arise when tattooing equipment is sold for private use to minors; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, that the Department of Health and the Department of Commerce and Consumer Affairs are requested to examine the feasibility and the advantages and disadvantages of restricting the sale of tattooing equipment to minors; and

 

     BE IT FURTHER RESOLVED that the Department of Health and the Department of Commerce and Consumer Affairs are requested to submit their findings and recommendations, including any proposed legislation, to the Legislature not later than twenty days prior to the convening of the Regular Session of 2010; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Health and the Director of Commerce and Consumer Affairs.
