A BILL FOR AN ACT
relating to capital improvement projects for the benefit of THE seventh SENATORIAL DISTRICT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The director of finance is authorized to issue general obligation bonds in the sum of $27,700,003 or so much thereof as may be necessary, and the same sum or so much thereof as may be necessary, is appropriated for fiscal year 2009-2010, for the purpose of capital improvement projects for the seventh senatorial district, as follows:
1. Kilauea water system
Kilauea school waterline improvements
Construction $800,000

2. Waimea water system
Waimea Canyon school waterline improvements
Construction $5,000,000
Total funding $5,000,000
3. Hanalei water system
Hanalei school waterline improvements
Plans $300,000
Total funding $300,000
4. Wailua-Kapaa water systems
A. Kapaa storage improvements
Design and construct a new one million gallon storage tank and connecting pipeline
Land $1,000,000
Total funding $1,000,000
B. Kawaihau road section, Kahuna and Piliamoo roads twelve inch and sixteen inch water mains

5. Wainiha-Haena water system
Design and construct a new one hundred thousand gallon storage tank, booster station, connecting pipeline, and appurtenances

SECTION 2. The appropriation made for the capital improvement projects enumerated in section 1 of this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date.
SECTION 3. The sums appropriated for the respective capital improvement projects set forth in section 1 of this Act shall be expended by:
(1) The department of water of the county of Kauai in the case of items 1 to 5;
(2) The county of Kauai, in the case of items 6, 8, 9, and 10;
(3) The department of land and natural resources through a contract with the Kauai Public Land Trust, in the case of item 7; and
(4) Kauai community college, in the case of item 11
for the purposes of this Act.
SECTION 4. The director of finance is authorized to issue general obligation bonds in the sum of $10,500,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2010-2011 for the purpose of capital improvement projects for the seventh senatorial district, as follows:
1. Hanalei water system

2. Wailua-Kapaa water systems
A. Kapaa storage improvements
Design and construct a new one million gallon storage tank and connecting pipeline

B. Kawaihau road section, Kahuna and Piliamoo roads twelve inch and sixteen inch water mains
Construction $4,500,000
Total funding $4,500,000
SECTION 5. The appropriation made for the capital improvement projects authorized by section 4 of this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date.
SECTION 6. The sums appropriated for the respective capital improvement projects set forth in section 4 of this Act shall be expended by the department of water of the county of Kauai.
SECTION 7. This Act shall take effect on July 1, 2009.
