A BILL FOR AN ACT


 

 

relating to public lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§171-     Limited right of entry; unencumbered public lands.  (a)  Any law to the contrary notwithstanding, any person, after obtaining a marriage license under chapter 572, shall have a right of entry, without charge, to perform a wedding ceremony on any unencumbered public lands; provided that:

     (1)  The wedding ceremony shall not use or setup any tents, chairs, tables, arches, stages, or any other apparatus;

     (2)  A permit fee of $      shall be charged for a yearly use permit; and

     (3)  The total number of people attending the wedding ceremony does not exceed fifty persons at any time.

     (b)  The limited right of entry granted in this section shall be valid concurrently with the marriage license for the length of time prescribed in section 572-6.

     (c)  The department shall adopt rules in accordance with chapter 91 for the purposes of this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
