A BILL FOR AN ACT

 

 

RELATING TO EXPLOSIVES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that dry ice bombs are one of the simplest types of bombs -- easily made by placing dry ice in a sealable plastic container and adding water.  The dry ice, consisting of solidified and compressed carbon dioxide, vaporizes to produce a quantity of carbon dioxide gas that ultimately exceeds the tensile strength of the container and produces an explosion.  Depending on the size of the container and the amount of dry ice used, dry ice bombs can produce dangerously loud explosions and potentially hazardous plastic shrapnel.

     The purpose of this Act is to amend Hawaii's firearms, ammunition, and dangerous weapons law to apply to dry ice bombs.

     SECTION 2.  Chapter 134, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§134-     Dry ice bombs; prohibition; penalty.  (a)  Any person who knowingly manufactures, sells, transfers, possesses, or transports in the state any dry ice bomb shall be guilty of a misdemeanor.

     (b)  Any person who:

     (1)  Knowingly possesses; or

     (2)  Intentionally uses or threatens to use;

a dry ice bomb while engaged in the commission of a crime shall be guilty of a class C felony.

(c)  As used in this section, "dry ice bomb" means any sealed device containing dry ice or other chemically reactive substances assembled for the purpose of causing an explosion by a chemical reaction.  "Dry ice bomb" does not include ammunition or reloading apparatuses for ammunition used in licensed firearms."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on December 21, 2058.
