A BILL FOR AN ACT
relating to concessions on public property.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 102, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§102- Airport concessionaires; preference for Hawaii businesses. (a) Notwithstanding any other provision of law to the contrary, the department of transportation, in awarding contracts for concessions to be operated at state airports, shall grant a preference to any bidder that is a Hawaii business, equivalent in amount to the preference granted to Hawaii products in section 103D-1002(d).
(b) As used in this section, "Hawaii business" means any person, agency, corporation, or other business entity with its principal place of business or ancillary headquarters located in the State.
(c) The department of transportation shall adopt rules in accordance with chapter 91 for the purposes of this subsection."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2010.
