A BILL FOR AN ACT


 

 

RELATING TO PHYSICIANS AND OSTEOPATHIC PHYSICIANS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§453-     Disclosure requirement; license revocation or suspension.  (a)  Any physician or osteopathic physician licensed pursuant to this chapter who has ever had a license to practice medicine or surgery suspended or revoked, whether in this State or in another jurisdiction, shall disclose that suspension or revocation in writing to all patients.  The disclosure shall be made once upon the first visit of each new patient, and once upon the first visit of each established patient subsequent to the effective date of this Act.

     (b)  Failure of a physician or osteopathic physician to comply with this section shall constitute an act of engaging in false, fraudulent, or deceptive advertising under section 453-8(a)(3)."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 4.  This Act shall take effect on July 1, 2009.
