HOUSE CONCURRENT

RESOLUTION

 

 

Urging the department of land and natural resources to consider public health and safety when issuing permits for commercial wedding or photographic ACTIVITIES on public lands.

 

 

 


     WHEREAS, Hawaii's beaches and sandy shorelines make the perfect backdrop for commercial wedding ceremonies and photographic activities, including photo shoots and video productions; and

 

     WHEREAS, currently, commercial wedding ceremonies and photographic activities are required to obtain a right-of-entry permit by the Department of Land and Natural Resources; and

 

     WHEREAS, there are no restrictions limiting the time in which a person can reapply for a permit if a right-of-entry permit is denied or revoked by the Department of Land and Natural Resources; and

 

     WHEREAS, some remote beaches and shoreline areas under state jurisdiction do not have legal facilities such as bathrooms and parking facilities; and

 

     WHEREAS, many commercial weddings and photographic activities on beaches and shoreline areas disturb and disrupt the neighboring community due to traffic, parking, equipment use, and the noise from people attending these functions; and

 

     WHEREAS, the surrounding community should be considered by the Department of Land and Natural Resources when permitting commercial weddings and photographic activities on public lands; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that the Legislature urges the Department of Land and Natural Resources, prior to issuing a right-of-entry permit for commercial wedding or photographic activities, to consider:

 

     (1)  Whether the permit site is equipped with legal facilities for the specific type of commercial activity;

 

     (2)  Whether the activity will affect the health and safety of the neighboring community; and

 

     (3)  Requiring a person who has a right of entry permit denied or revoked to wait at least six months prior to obtaining a new permit; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to submit a report relating to commercial wedding and photography permits issued by the Department to the Legislature, no later than twenty days prior to the convening of the Regular Session of 2011, which is requested to include:

 

     (1)  The number of commercial wedding and photographic permits issued in the last two years;

 

     (2)  The number and type of complaints filed with the Department of Land and Natural Resources, including the geographic area regarding each complaint; and

 

     (3)  Whether any actions were taken by the Department of Land and Natural Resources to address the complaints and the results of those actions; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
