A BILL FOR AN ACT

 

 

RELATING TO SOLID WASTE MANAGEMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342G‑    Municipal solid waste prohibition.  (a)  Beginning July 1, 2017, the largest landfill existing as of January 1, 2011, in a county with a population greater than or equal to five hundred thousand residents shall not accept deliveries of municipal solid waste.

     (b)  After a date to be determined by resolution of the respective legislative body of a county, no landfill in a county with a population of less than five hundred thousand residents shall accept deliveries of municipal solid waste.

     (c)  The prohibitions of this section shall not apply to special waste or waste created as a result of a natural disaster."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Prohibits the largest landfill as of 1/1/2011 in a county with a population greater than or equal to 500,000 from accepting municipal solid waste, beginning 7/1/17.  Prohibits landfills in counties with populations less than 500,000 from accepting municipal solid waste after a date determined by council resolution.  (SD1)
