RELATING TO TAXATION.

PROPOSED HD1:  Amends the method of computing the estate and transfer tax.  Repeals income tax credit for resident taxpayers for income taxes paid to other jurisdictions.  Imposes an excise tax on direct broadcast satellite service providers.

RELATING TO THE DEPARTMENT OF EDUCATION.

Authorizes schools to grow food in school gardens for consumption in the school lunch program as long as the food used is inspected and certified as safe by the Department of Agriculture.

RELATING TO CONVEYANCE TAX.

Requires the Director of Taxation to provide the administrator of each county's real property assessment division with an image of all certificates of conveyances filed with the Bureau of Conveyances within ten days after the end of each week.  Effective July 1, 2011.

RELATING TO THE CACAO INDUSTRY.

Temporarily exempting from the general excise tax (GET) amounts received for the sale of cacao from a producer or processed cacao from a processor.  Requires the Department of Agriculture to collaborate with other state agencies to determine the best locations for a cacao processing facility.

RELATING TO ELECTIONS.

Provides for instant runoff voting for all elections in which no primary election is held; authorizes the chief election officer or the county clerk to use the instant runoff voting method in special elections that would normally require a separate runoff election if no candidate received a majority of votes.  Effective January 7, 2059.

RELATING TO EDUCATION.

Changes the salary cap for the deputy superintendent, assistant superintendents, and complex area superintendents from eighty percent of the superintendent's salary to the superintendent's salary.

RELATING TO PUBLIC SCHOOL LANDS.

Establishes the public school lands trust to provide for the maximum use of public school lands in order to generate income to improve public school facilities and infrastructure to meet the challenges of the twenty-first century and beyond.

RELATING TO FINGERPRINT RETENTION BY HAWAII CRIMINAL JUSTICE DATA CENTER.

Allows the State to retain fingerprints of employment and licensing applicants for whom criminal history record checks are authorized statutorily so that the State can implement a statewide "Rapback" program.  Effective July 1, 2011.

RELATING TO INTRA-STATE AVIATION.

Exempts the general excise and use taxes on fuel sold from a foreign-trade zone to common carriers for use in interisland air transportation.  Effective July 1, 2011.

RELATING TO MOTOR VEHICLE RENTAL.

Allows certain lessors whose primary business is to rent motor vehicles to calculate the licensing, registration, and inspection fees and weight taxes passed on to consumers based on a good-faith estimate of actual cost.  Effective July 1, 2011.

RELATING TO DELIVERY OF GOVERNMENT SERVICES.

Requires the directors of DOH and DHS to collaborate with contracted health and human services providers to develop, and update annually, a health and human services delivery plan.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
