A BILL FOR AN ACT

 

 

relating to TEMPORARY ASSISTANCE FOR NEEDY FAMILIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-    Drug testing.  Any applicant or recipient of temporary assistance for needy families cash benefits who the department has reasonable cause to believe engages in the illegal use of a controlled substance shall be subject to drug testing to be eligible for the cash benefits.  Any applicant or recipient who tests positive for the use of a controlled substance that was not prescribed for the applicant or recipient by a licensed health care provider or who refuses to consent to a drug test shall be ineligible to receive cash benefits for a period of one year.  The department shall adopt rules pursuant to chapter 91 as necessary to effectuate this section."
     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
