A BILL FOR AN ACT

 

 

relating to historic preservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§6E-    Plan approval or acceptance.  (a)  The approval or acceptance of any archaeological inventory survey, mitigation plan, preservation plan, interpretive plan, or other plan or study by the state historic preservation officer shall have no further force or effect after the passage of ten years from the date of the original approval or acceptance.

     (b)  If approval or acceptance of any archaeological inventory survey, mitigation plan, preservation plan, interpretive plan, or other plan or study is a condition precedent for issuance of a permit or other necessary approval for a project and ten or more years has passed from the date of the original approval or acceptance, a new plan or update of the original plan or study shall be prepared for the approval and acceptance of the state historic preservation officer.

     (c)  The board of land and natural resources shall adopt rules under chapter 91 necessary to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
