A BILL FOR AN ACT

 

 

RELATING TO THE CONVENTION CENTER.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 206E, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   .  Convention center district

     §206E-    Convention center district; purpose.  The authority shall serve as the local redevelopment authority of the district to develop uses and activities that promote and encourage use of the convention center.  In addition to any other of its duties under this chapter, the authority shall:

     (1)  Consult with recorded landowners in the district to implement activities related to and supportive of the convention center;

     (2)  Assist land users to manage their properties and implement activities related to and supportive of the convention center; and

     (3)  Work with federal, state, county, and other agencies to ensure that infrastructural support is provided for the district.

     §206E-    Convention center district established; boundaries.  The convention center district is hereby established.  The district shall include the area bounded by  the mauka, ewa, and makai perimeter of the Hawaii convention center parcel; the ewa boundary of the Ala Wai canal promenade, identified as the Ewa boundary of tax map key            , from its intersection with the makai perimeter of the Hawaii convention center parcel until its intersection with the mauka boundary of the Ala Moana boulevard roadway; the mauka boundary of the Ala Moana boulevard roadway from its intersection with the ewa boundary of the Ala Wai promenade, identified as the Ewa boundary of tax map key           , until the makai boundary of the Kalakaua avenue roadway; the makai boundary of the Kalakaua avenue roadway from its intersection with Ala Moana boulevard until its intersection with the ewa boundary of the Ala Wai promenade, identified as the Ewa boundary of tax map key          ; and the ewa boundary of the Ala Wai promenade, identified as the Ewa boundary of tax map key          , until its intersection with the mauka perimeter of the Hawaii convention center parcel.

     §206E-    Convention center district board establishment.  (a)  Notwithstanding section 206E-3(b), there is established a convention center district board, which shall consist of the members of the Hawaii tourism authority board.  At least two members shall be representatives of businesses located within the boundaries of the designated district appointed by the governor pursuant to section 26-34.

     (b)  The members of the board shall elect a chairperson from among its public members. 

     (c)  Eight members shall constitute a quorum and a minimum of eight affirmative votes shall be necessary for all actions by the board.

     (d)  The members may form ad hoc advisory groups with expertise, knowledge, and experience in land economics, development, real estate, business, finance, marketing, management, event planning, and the visitor industry.

     (e)  As used in this part "board" means the convention center district board.

     §206E-    Powers of the board; generally.  Except as otherwise limited by this chapter, the board may:

     (1)  Make an execute contracts and all other instruments necessary or convenient for the exercise of its powers and functions under this part;

     (2)  Make rules with respect to its projects, operations, properties, and facilities, which rules shall be in conformance with chapter 91;

     (3)  Prepare or cause to be prepared a convention center district development plan;

     (4)  Exercise the powers of the Hawaii community development authority within the convention center district;

     (5)  Through the authority, acquire, reacquire, or contract to acquire or reacquire by grant or purchase real, personal, or mixed property or any interest therein; to own, hold, clear, improve, and rehabilitate, and to sell, assign, exchange, transfer, convey, lease, or otherwise dispose of or encumber the same; provided that the board may not sell, assign, transfer, or convey any real property located in the district; 

     (6)  Through the authority, acquire or reacquire by condemnation real, personal, or mixed property or any interest therein for public facilities, including but not limited to streets, sidewalks, parks, and other public improvements;

     (7)  Through the authority, or partnership with qualified persons, acquire, reacquire, construct, reconstruct, rehabilitate, improve, alter, or repair of any project; own, lease, or encumber any project; and repurchase or otherwise acquire any project which the authority has theretofore sold or otherwise conveyed, transferred, or disposed of;

     (8)  Through the authority, arrange or contract for the planning, replanning, opening, grading, or closing of streets, roads, roadways, alleys, or other places, or for the furnishing of facilities or for the acquisition of property or property rights, or for the furnishing of property or services in connection with a project;

     (9)  Prepare or cause to be prepared plans, specifications, designs, and estimates of costs for construction, reconstruction, rehabilitation, improvement, alteration, or repair of any project, and from time to time modify such plans, specifications, designs, or estimates;

    (10)  Provide advisory, consultative, training, and educational services, technical assistance, and advice to any person, partnership, or corporation, either public or private, to carry out the purposes of this part, and engage the services of consultants on a contractual basis for rendering professional and technical assistance and advice; and

    (11)  Do any and all things necessary to carry out its purposes and exercise the powers given and granted in this part.

     §206E-    Convention center district; policies to guide development.  The following general policies to guide development shall govern the authority's actions in the convention center district:

     (1)  The authority may engage in planning, design, and construction activities within and outside the district that are in furtherance of promoting the use of the convention center; provided that activities outside the district shall relate to infrastructural development, area-wide drainage improvements and sediment transport mitigation, roadway realignments and improvements, and other activities the authority deems necessary to carry out the redevelopment of the district and implement this part.  Studies or coordinating activities may be undertaken by the authority in conjunction with the county and appropriate federal and state agencies and may address infrastructural systems, natural resource systems, and other activities;

     (2)  Planning, replanning, rehabilitation, development, redevelopment, and other preparations for the promotion of convention center use shall be pursued;

     (3)  Hawaiian archaeological, historic, and cultural sites shall be preserved and protected to the extent feasible while allowing for continued use of the property for promotion of use of the convention center;

     (4)  Endangered species of flora and fauna shall be preserved and protected to the extent feasible;

     (5)  Land use and redevelopment activities within the district shall be coordinated with and, to the extent possible, complement existing county and state policies, plans, and programs affecting the district; and

     (6)  Public facilities within the district shall be planned, located, and developed to support the redevelopment policies established by this part for the district and rules adopted pursuant thereto.

     §206E-    Convention center district revolving fund.  (a)  There is established in the state treasury the convention center district revolving fund, into which shall be deposited:

     (1)  All revenues, income, and receipts of the authority for the district, notwithstanding any other law to the contrary, including section 206E-16;

     (2)  Moneys directed, allocated, or disbursed to the district from government agencies or private individuals or organizations, including grants, gifts, awards, donations, and assessments of landowners for costs to administer and operate the district; and

     (3)       Moneys appropriated to the fund by the legislature.

     (b)  Moneys in the fund shall be used only for the purposes of this part.

     (c)  Investment earnings credited to the assets of the fund shall become part of the fund.

     §206E-    Rules; adoption.  The authority shall adopt rules in accordance with chapter 91 to carry out the purposes of this part."

     SECTION 2.  This Act shall take effect on July 1, 2030.
