Clarifies that attorney's fees may be included in costs that may be assessed against a party who brings, prosecutes, or defends a workers' compensation claim without reasonable ground.  Effective July 1, 2112.  (HB2099 HD1)

RELATING TO THE PENAL CODE.

Amends penalties for negligent homicide in the second degree, negligent homicide in the third degree, and negligent injury in the second degree when the incident involves a vulnerable highway user.  Adds definitions.  Effective January 7, 2059.  (HB1666 HD1)

RELATING TO THE HAWAII UNIFORM COLLABORATIVE LAW ACT.

Enacts Uniform Collaborative Law Act, which authorizes disputants to enter into collaborative law participation agreements signifying interest to resolve the dispute without intervention of a tribunal (court or other third party decision maker).  Requires parties to a collaborative law process to disclose information fully, candidly, and informally without formal discovery.  Subject to certain exceptions, disqualifies attorneys in the collaborative process (and their law firms) from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter.

RELATING TO COLLECTIVE BARGAINING.

Clarifies that negotiations relating to contributions to the Hawaii employer-union health benefits trust fund (EUTF) shall be to agree upon amounts that the State and counties shall contribute toward the payment of costs for a health benefits plan and group life insurance benefits for active public employees; repeals prohibition on the use of arbitration to resolve impasses or disputes relating to the amounts contributed to by the State and counties clarifies that a decision of an arbitration panel shall be final. Effective 07/01/50. (Proposed SD1)
