Status

RELATING TO FEE TIME SHARE INTERESTS.

Requires all fee time share interests to be recorded in the regular system rather than the land court.  Streamlines the procedure for the office of the assistant registrar to update the certificates of title for all remaining fee time share interests as part of the deregistration process.  Allows the bureau of conveyances to charge a transaction fee for each deed of a time share interest recorded in the bureau of conveyances pursuant to chapter 502, Hawaii Revised Statutes.  Effective 07/01/2020.  (SD1)

Status

RELATING TO TRANSIENT ACCOMMODATIONS.

Requires any nonresident owner who operates a transient accommodation located in the nonresident owner's private residence to employ a real estate broker or salesperson.  Requires any nonresident owner who operates a transient accommodation located in the nonresident owner's private residence in a condominium hotel to employ a condominium hotel operator.  Requires relevant information about owners of the transient accommodation to be provided to the department of taxation for enforcement purposes.  Requires the counties to provide the department of taxation with relevant owner information about every transient accommodation permitted by the respective counties annually.  Establishes fines for noncompliance.  Provides an exemption from the mandatory employment of a licensed real estate broker or salesperson or condominium hotel operator in certain circumstances.  (SD1)

Requires that a plan manager keep an accurate and current list of the names and addresses of time share association members; requires the list of time share association members to be made available to owners under certain terms and for reasonable costs.  (SD1)

Provides for the allocation of transient accommodations tax revenues to the convention center enterprise special fund on a fiscal year basis.  (SD1)

RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.

Clarifies that the daily $10 tax on transient accommodations furnished on a complimentary or gratuitous basis includes transient accommodations furnished as part of a travel package, but does not include transient accommodations furnished as part of a tourism industry promotional or marketing activity.  (SD2)

RELATING TO TRAVEL AND TOURISM STIMULUS INITIATIVES.

Provides an employer tax credit of 4.5 per cent of the wages paid by a qualified employer to certain employees for seven years after completion of hotel and resort construction and renovation; provides a general excise tax exemption for hotel and resort construction and renovation and for the operation of these hotels and resorts for seven years after substantial completion of construction and renovation; requires construction and renovation of a hotel facility or resort facility to be completed by 6/30/2017 to be eligible for the exemption; employer tax credit applies to taxable years beginning after 12/31/2011; hotel and resort construction and renovation general excise tax exemption applies to taxable periods beginning after 7/1/2050.  (SD2)

Status

RELATING TO THE HAWAII TOURISM AUTHORITY.

Increases the allocation of the transient accommodations tax revenue for the Hawaii tourism authority from $69,000,000 to $71,000,000 until 06/30/2015; requires $2,000,000 to be expended for development and implementation of initiatives to take advantage of expanded visa programs and increased travel opportunities for international visitors to Hawaii.  Effective 07/01/2050.  (SD3)

MAKING AN APPROPRIATION FOR THE HAWAII TOURISM AUTHORITY.

Appropriates an unspecified sum for the Hawaii tourism authority for fiscal year 2012-2013 for initiatives to take advantage of expanded visa programs and increased travel opportunities for international visitors to Hawaii.  (SD1)
