A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-     School gardens.  (a)  All schools may grow food in school gardens for consumption in their school meals programs; provided that food products used in a school meals program shall be inspected and certified as safe by the department of agriculture.

     (b)  Upon request by a school, a nonprofit organization, as defined in section 302D-1, may establish and administer a fresh food distribution service.

     (c)  The department may adopt rules under chapter 91 to implement this section.

     (d)  The department shall not be liable to any person for any sickness or contamination that results from the use of fresh foods from the school garden, except when the sickness or contamination is caused by a condition resulting from the department's failure to comply with sanitation and hygiene standards established by the department for school lunch programs."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the establishment and support of school gardens and the use of food grown in such gardens in school meals programs.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
