A BILL FOR AN ACT

 

 

RELATING TO LANDOWNERS' LIABILITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 662, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§662-     Limited liability for mountain climbing, rock climbing, rappelling, and bouldering.  No public entity or public employee shall be liable to any person for injury or damage sustained on government land when engaged in mountain climbing, rock climbing, rappelling, and bouldering."

     SECTION 2.  Section 520-2, Hawaii Revised Statutes, is amended by amending the definition of "land" to read as follows:

     ""Land" means land, roads, water, watercourses, private ways and buildings, structures, and machinery or equipment when attached to realty[, other than lands owned by the government]."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
