A BILL FOR AN ACT

 

 

relating to the department of public safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§353C-     Prospective deputy sheriffs; psychological evaluations.  Effective July 1, 2014, the department shall test all applicants for a deputy sheriff position to determine the applicant's psychological fitness for the position.  The department shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 2.  (a)  The department of public safety shall:

     (1)  Establish a budget; and

     (2)  Develop and execute an implementation plan;

to provide for the department's use of electric guns, as that term is defined in section 134-1, Hawaii Revised Statutes, in accordance with the provisions of section 134-16, Hawaii Revised Statutes, and to be implemented no later than January 1, 2015.

     (b)  The department of public safety shall submit a report on its responsibilities established under subsection (a) to the legislature no later than twenty days prior to the convening of the 2014 regular session.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Requires PSD to test all prospective deputy sheriffs beginning on 07/01/2014, for psychological fitness for the position.  Requires PSD to establish a budget and an implementation plan providing for PSD's use of electric guns by 01/01/2015.
