A BILL FOR AN ACT

 

 

relating to animalS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§711-    Definitions.  In this section, unless a different meaning is plainly required:

     "Equine animal" means an animal of or belonging to the family Equidae, including horses, ponies, mules, donkeys, asses, burros, and zebras.

     "Feral" means animals that have escaped or been released from domestication and are living in a wild and unconfined state.

     "Pet" means a domesticated dog, cat, or equine animal, and includes feral dogs, cats, or equine animals.

     §711-    Killing a pet for human consumption.  (1)  A person commits the offense of killing a pet for human consumption if the person:

    (a)   Possesses, sells, buys, gives away, accepts, holds, steals, transports, or imports into or exports from the State any pet with the intent of killing, or having another kill, that pet if that person knows or should have known that any part of that pet will be used for human consumption;

    (b)   Breeds any pet with the intent to use the pet for human consumption or sell or give away that pet for human consumption; or

    (c)   Knowingly consumes any pet on any occasion, including ethnic holidays or events.

     (2)  Violation of this section shall be a class B felony.

     (3)  If there is any conflict between this section and section 711-1109, or any other provision of law, this section shall apply."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
